Legal Notices Reqarding our Service and our Web site.
All businesses must face the fact that they are a legal entity and, as such, enter into legal agreements upon accepting an assignment of work from a client. In light of that fact, Powerwriting.com and its owner, Power Communications LLC must publish certain legal notices of which you should be aware. Both Powerwriting and its clients have certain obligations. In addition, visitors to our site should be aware of all legal issues. They are outlined below.
When a client or prospective client tells us something in confidence we consider it strictly private. As long as a client does not breach our contract we consider our relationship private to the extent outlined in our written agreement. We do not disclose private information about clients in good standing when we know the information is indeed private.
For your convenience and because of the nature of the Internet, we accept payment in advance. You have several payment options. You may pay by Company check, EFT, Money Order or certified bank check. We sometimes accept credit cards or PayPal. And, as I'm sure you can understand, we don't give refunds and don't make guarantees other than the guarantee to provide professional, timely copywriting service.
I rarely need to deal with refunds or chargebacks. Nevertheless, my refund policy is simple - I don't make refunds.
My attorney insists that I publish the fact that because of the nature of online services, chargebacks or stop pays on checks or any attempt to stop a payment will be considered theft and treated as fraud. Services once done cannot be undone. It's not like merchandise which can simply be returned. In addition, you are buying my time and my skill and not a certain result or tangible item.
Any issues regarding my work will be resolved through negotiation, but in any case not by refund. Chargebacks and stop payments will be publicly blacklisted and reported to the appropriate offline and online authorities. Clients responsible for chargebacks will face severe legal consequences and penalties.
COLLECTIONS, STOP-PAYMENTS , BAD CHECKS AND CHARGE BACKS
Collections, stop payment on checks and charge backs are seldom an issue with us. We must, however, provide for the possibility. You agree that all payments you initiate in which charges are made to your credit card or bank account or a credit card or bank account over which you have control are final and not reversible.
You agree that you will not charge back any amounts charged to a credit card or bank account by PayPal or Power Communications. If you charge back a credit card charge or amount from a bank account for a payment initiated by you, you agree that Power Communications or PayPal may recover the amount of the chargeback by either reducing Your PayPal account balance or other means or re-charging your credit card or bank account for the amount of the chargeback or bounced check.
You agree that Power Communications may charge an administrative fee to recover costs associated with the above.
You agree to pay any and all legal fees, travel expenses and other expenses that Power Communications incurs that are associated with any chargeback or stop pay on a check or other instrument and any attempt to collect fees due Power Communications by you.
Under Kansas law, if a person gives a worthless check, they are liable to us for the amount of the check, the incurred court costs, the costs of restricted mail and the service charge and the costs of collection, including but not limited to reasonable attorney fees, plus an amount equal to the greater of the following: Damages equal to three times the amount of the check but not exceeding the amount of the check by more than $500.
To sum up:
- We give no refunds.
- We offer no guarantees other than the guarantee to provide professional, timely copywriting service.
- We prosecute any attempt at a chargeback or stop payment.
- We publically inform other copywriters, service providers and merchants about people who attempt to steal our services through any of these illegal, unethical methods.
- We post bad checks and stop-pay checks.
